(a) If a Federal court finds that a Personal Radio Service stationoperator has willfully and knowingly violated any provision of the Communications Act, that operator may be fined up to $10,000 or be imprisoned for a period not exceeding one year, or both. Upon a subsequent violation, the imprisonment may be for a period not exceeding two years. See § 501 of the Communications Act (47 U.S.C. 501).

Just because the FCC can doesn't mean they will. In my area I hear 10x more unlicensed traffic than licensed. I'm talking fixed base homesteads, hunters, some off roaders and no one really cares.
If you do happen to get on radar it can be a tough deal, offending equipment confiscation can be immediate, forfeiture is after a court decision. I heard an anecdotal story about a bunch of agricultural guys running unlicensed on marine bands in the midwest (like way far from the water) to talk between equipment and one day the FCC showed up, yanked their radios, and slapped each user with a $5k fine. YMMV
